CALIFORNIA STATE PERSONNEL BOARD SPECIFICATION DEPUTY COMMISSIONER, DEPARTMENT OF REAL ESTATE Series Specification (Established July 1, 1980) SCOPE This series specification describes two recruiting, development, and specialist classes for persons qualified to learn and perform technical and analytical staff work in connection with the review and enforcement of laws, regulations, and procedures administered by the Department of Real Estate. The predominant duties of these positions relate to the real estate research, enforcement, licensing, subdivision, and recovery functions in the Department of Real Estate, and require a thorough and detailed knowledge of the appropriate laws, rules, and regulations pertaining to these functions. Possession of the criteria described in Alternate Range Criteria 128, Range B, in this specification permits entry at the Deputy Commissioner, Department of Real Estate, Range B, level. FACTORS AFFECTING POSITION ALLOCATION Overall scope, variety, complexity, and difficulty of technical work to be performed; independence of action and level of decision making, supervision received, and degree of originality in performing job duties enter into position allocations. Additional considerations which enter into determination of borderline allocations include such factors as experience and knowledge necessary to perform the work, the degree of independence and judgment required in making determinations, and the consequences of error. DEFINITION OF LEVELS* DEPUTY COMMISSIONER, DEPARTMENT OF REAL ESTATE This is the recruiting, developmental, first journey level, and full journey level for this series. Employees are assigned duties and responsibilities commensurate with their background and training. Under either supervision, general supervision, or direction, and in accordance with established procedures, incumbents perform increasingly difficult to complex duties in the Department of Real Estate. Employees can perform a variety of tasks including the more independent, responsible, varied, and complex investigations and files in connection with the review and enforcement of laws, rules, and regulations administered by the Department of Real Estate, or perform responsible staff work in one of the Real Estate services or functions. The work can often be characterized by independent development and employment of investigative or review techniques. Assignments can involve the more complex files, cases, and staff assignments with a minimum of supervision; incumbents may act in a lead capacity; and do other related work. SENIOR DEPUTY COMMISSIONER, DEPARTMENT OF REAL ESTATE This is the advanced journey level class. Under direction, incumbents work independently with primary responsibility for a major function or activity in the Department of Real Estate. Positions are assigned difficult and complex work in conjunction with specific functions or activities within the Department; incumbents perform specialized analysis and investigations; may function as the senior member of a team; and do other related work. MINIMUM QUALIFICATIONS DEPUTY COMMISSIONER, DEPARTMENT OF REAL ESTATE Either I Education: Equivalent to graduation from college (four-year bachelor's degree) or equivalent degree (certificate) (diploma) approved by the Bureau for Private Postsecondary and Vocational Education under the provisions of California Education Code Chapter 3, Part 59, Division 10, and with any major but preferably with specialization in real estate, law, finance, criminal justice, or public or business administration. Registration as a senior in a recognized institution will admit applicants to the examination, but they must produce evidence of graduation or its equivalent before they can be considered eligible for appointment. Or II Education: Successful completion at an accredited college of 60 semester units or 90 quarter units (preferably with an emphasis on real estate, law, finance, criminal justice, or public or business administration). and Experience: Two years of experience in one of the following: 1. Sale or exchange of farm, residential, or business properties. or 2. Negotiating for real estate loans in a bank, realty office, or savings and loan (requires extensive dealing with the public). or 3. Performing the duties of an Escrow Officer in a bank, realty, savings and loan, or escrow or title company. or 4. Independent field investigative experience in civil or criminal law enforcement with a private or governmental agency. Or III Experience: In one or a combination of the following: 1. Eighteen months' experience with the Department of Real Estate performing the duties of a class at a level of responsibility equivalent to a Program Technician II, Office Services Supervisor I, or Office Technician. or 2. Two years of experience with the Department of Real Estate as a Program Technician. and Education: Successful completion at an accredited college of 18 quarter units or 12 semester units of which six semester or nine quarter units must be in Real Estate Principles, Real Estate Practice, Real Estate Appraisal, Legal Aspects of Real Estate, Real Estate Finance, Real Estate Economics, or Real Estate Accounting. The remaining units shall be in the core courses required for a major in public or business administration, law, finance, or criminal justice. SENIOR DEPUTY COMMISSIONER, DEPARTMENT OF REAL ESTATE Either I Experience: One year of experience in the California state service performing the duties of a Deputy Commissioner, Department of Real Estate (Range D). Or II Experience: Two years of experience in the California state service performing the duties of a Deputy Commissioner, Department of Real Estate (Range C). Or III Experience: Three years of experience in one of the following: 1. Sale or exchange of farm, residential, or business properties. or 2. Negotiating for real estate loans in a bank, realty office, or savings and loan (requires extensive dealing with the public). or 3. Performing the duties of an Escrow Officer in a bank, realty office, savings and loan, or escrow or title company. or 4. SENIOR DEPUTY COMMISSIONER, DEPARTMENT OF REAL ESTATE Knowledge of: All of the above, and the California Real Estate Law; Department of Real Estate rules, regulations, policies, and procedures; Department of Real Estate organization and functions; related legal opinions; methods, laws, and procedures controlling the subdivision of lands and time-share regulations; investigation methods, evidence, and procedures applicable to criminal and administrative proceedings; advanced fee and mortgage loan broker laws, rules, and regulations; out-of-State subdivision regulations; time-share and undivided interest procedures and regulations; publication procedures and policies. Ability to: All of the above, and interpret and apply provisions of the California Real Estate law and the laws governing the Subdivided Lands Act, related legal opinions and court decisions, and Department of Real Estate policies, procedures, rules, and regulations; independently perform complex, specialized analysis projects and functions within the Department of Real Estate. SPECIAL PERSONAL REQUIREMENTS ALL LEVELS: Demonstrated ability to act independently with flexibility and tact. Some positions: Willingness to travel. ALTERNATE RANGE CRITERIA DEPUTY COMMISSIONER I, DEPARTMENT OF REAL ESTATE Experience gained outside State service may be credited only if the appointing power believes the experience was satisfactory and comparable in the type and quality to that of a Deputy Commissioner, Department of Real Estate. When the requirements for the particular criteria are met, and upon recommendation of the appointing power, the employee shall receive a rate under the provisions of Department of Personnel Rule 599.676. Range A. This range shall apply to incumbents who do not meet the criteria for payment in Range B, Range C, or Range D. Range B. This range shall apply to persons who have satisfactorily completed: 1. Six months of service in Range A. or 2. In addition to the education requirements in the "Minimum Qualifications" for Range A, have successfully completed at an accredited college at least another 12 semester units or 18 quarter units in the following courses: Real Estate Practice, Real Estate Appraisal, Legal Aspects of Real Estate, Real Estate Finance, Real Estate Economics, Real Estate Accounting, or advanced Real Estate courses. or 3. In addition to the "Minimum Qualifications" for Range A, have completed one additional year of experience as an investigator in civil or criminal law enforcement for a governmental or private agency. Range C. This range shall apply to persons who have satisfactorily completed six months of service in Range B. Range D. This range shall apply to persons who have satisfactorily completed 12 months of service in Range C.
