State of California MEMORANDUM DATE: November 29, 1994 TO: PERSONNEL MANAGEMENT LIAISONS REFERENCE CODE: 94-64 THIS MEMORANDUM SHOULD BE DISTRIBUTED TO: DEPARTMENT TRAINING OFFICERS FROM: Department of Personnel Administration Benefits and Training Division SUBJECT: SOUTHWEST REGIONAL TRAINING CENTER The Department of Personnel Administration (DPA) has been advised by the Department of Rehabilitation that a State employee has filed a formal complaint against the Southwest Regional Training Center for failure to provide proper facility access for employees with disabilities. The complaint cites the Americans with Disabilities Act (ADA) requirements for barrier free access to all facilities provided for employee training activities. While the Southwest Regional Training Center is a private corporation and is not affiliated with the State of California in any way, it markets its programs to State agencies and is a major source of out-service training in the Los Angeles area. Departments are strongly advised to stop sending employees to the Southwest Regional Training Center until such time that its facilities and program support are in complete compliance with the accessibility requirements of the ADA. Departments are further reminded that it is the employer's responsibility to ensure that any private or public vendors that sponsor training programs for employees offer these programs in facilities that are free from barriers that would inhibit an employee's ability to participate fully in the training activities.
