State of California M E M O R A N D U M REFERENCE CODE: 2001-005 DATE: January 16, 2001 TO: Personnel Officers Personnel Transactions Supervisors FROM: Department of Personnel Administration Classification and Compensation Division SUBJECT: Cesar Chavez Holiday CONTACT: Clarice Pace, Personnel Management Technician (916) 324-0439, CALNET 454-0439 FAX: (916) 327-1886 Email: ClaricePace@dpa.ca.gov This is to advise departments that SB 984 amended Government Code Sections 19853 for excluded employees and 19853.1 for Unit 5 employees to include March 31 as an official State holiday to celebrate Cesar Chavez Day. Furthermore, as required by these statutes, the Department of Personnel Administration (DPA) has negotiated an agreement with all 21 bargaining units establishing March 31 as an official State holiday commemorating Cesar Chavez. Since March 31, 2001 falls on a Saturday, State employees will receive a holiday credit consistent with their time base up to a maximum of eight hours. The amount of paid time off will be based on the employee's time base as of the March pay period. Additional information on Saturday holidays is contained in Personnel Management Memoranda 98- 023 and 2000-007. Personnel Officers should also review the appropriate collective bargaining agreements for those bargaining units that have unique holiday provisions. For example, Unit 5 has holiday-in-lieu credit and Units 8, 12, and 13 have floating holidays. If your personnel office staff needs additional information regarding this holiday, please contact Clarice Pace, Personnel Management Technician, within the Personnel Services Branch, Classification and Compensation Division, at DPA, as shown above.
