Radeleff, Labor Relations Officer (916) 323-7998 FAX: (916) 322-0765 Email: JerryRadeleff@DPA.CA.GOV The purpose of this memo is to provide information regarding the recently negotiated Side Letter, Annual Leave, dated March 23, 2000, for Bargaining Unit 1 employees. The Side Letter contains the following provisions: 1. Any employee who is currently enrolled in the Annual Leave Program and transfers into Bargaining Unit 1 after May 1, 2000, shall have their enrollment in the Annual Leave Program terminated, effective the first of the month following their transfer into Bargaining Unit 1. Such employees shall be enrolled in the vacation and sick leave programs as specified in the Bargaining Unit 1 Contract. This provision applies to employees who move into Bargaining Unit 1 after May 1, 2000 and are in the Annual Leave Program. They must be transferred to the vacation/sick leave programs of the Contract. 2. Any employee who is or was enrolled in the Annual Leave Program and moved into Bargaining Unit 1 prior to May 1, 2000 may elect either of the following: a. Remain in the Annual Leave Program until July 2, 2001, such election to be retroactive to the date of their enrollment in the Annual Leave Program was terminated; or, b. Convert to the Vacation/Sick Leave programs as specified in Article 8, such election to be retroactive to December 1, 1999 or the month following their transfer into Bargaining Unit 1, whichever is later. Whether or not an employee was terminated from the Annual Leave Program they must be given an election form and they must elect either to remain in, or revert back to Annual Leave effective the date they were changed to vacation/sick leave. Employees who elect the vacation/sick leave program will have an effective date of December 1, 1999. 3. An employee who fails to return their election form to their Personnel/Human Resources unit by five (5) p.m., May 20, 2000, will be placed in the vacation/sick leave programs as specified in the Bargaining Unit 1 Contract. An employee, whose enrollment in the Annual Leave Program is terminated (elects the vacation/sick leave program), will retain the right to use their Annual Leave credit, under Sections 1 and 2 above, pursuant to Article 8.12, Leave Credits Upon Transfer in State Service, and Article 21.9, Transfer from Annual Leave Program, and shall be credited with vacation/sick leave effective the month following termination of their participation in the Annual Leave Program. Employees who elect to convert to vacation/sick leave should be given ample time to reduce their hours to the 400 hour cap as required under the vacation provisions of the Contract. EMPLOYEES QUESTIONS AND ANSWERS - BARGAINING UNIT 1 Q #1: Can new hires choose the Annual Leave Program? A: No. New hires must be placed in the vacation/sick leave programs. Q #2: Can employees in Bargaining Unit 1, who are enrolled in the vacation/sick leave programs change to the Annual Leave Program? A: No. This Side Letter only applies to those employees who moved into Bargaining Unit 1 and were in the Annual Leave Program as of December 1, 1999 or later. Q #3: What happens if an employee does not return their election form to remain in or change to the vacation/sick leave program by the close of business on May 20, 2000? A: They must be placed in the vacation/sick leave programs. Q #4: Can employees in the Annual Leave program and who move to Bargaining Units that do not have Annual Leave stay in Annual Leave? A: Refer to the appropriate Bargaining Unit Contract or contact the appropriate Labor Relations Officer at DPA. Q #5: Can an employee who elects the vacation/sick leave programs be changed prior to December 1, 1999? A: No. Election to vacation/sick leave is retroactive only to December 1, 1999 or the month following their transfer into the Bargaining Unit, whichever is later. FAILURE TO RETURN THE ELECTION FORM TO THE PERSONNEL/HUMAN RESOURCES OFFICE BY 5 PM MAY 20, 2000, SHALL CONSTITUTE AN ELECTION TO CONVERT TO THE VACATION/SICK LEAVE PROGRAMS AS SPECIFIED IN ARTICLE 8, LEAVES. Employees whose enrollment in the Annual Leave Program is terminated under section 2 (above), will retain the right to use Annual Leave credit, per the Bargaining Unit 1 Contract, Article 8.12 Leave Credits Upon Transfer in State Service and Article 21.9, Transfer from Annual Leave Program. Vacation/Sick Leave shall begin to be credited effective the month following the termination of the employee's participation in the Annual Leave Program.
