ARTICLE 3 ORGANIZATIONAL SECURITY 3.1 Maintenance of Membership a. It is the intent of this Section to provide for payroll deductions of Union members for Union membership to be deducted from their warrants insofar as permitted by law. The State agrees to deduct and transmit to the Union all authorized deductions from all Union members who have signed an approved authorization card for such deductions on a form provided by the Union, less necessary administrative costs incurred by the State Controller. (1) The written authorization for payroll deductions for Union membership shall remain in full force and effect during the life of this Contract except that any employee may withdraw from the Union by sending a signed withdrawal letter to the Union within thirty (30) calendar days prior to the expiration of this Contract. (2) The amount of dues deducted by Union members' pay warrants shall be set by the Union and changed by the State upon written request of the Union. (3) The Union agrees to indemnify, defend, and hold the State harmless against any claims made of any nature against any suit instituted against the State arising from its checkoff for Union deductions. b. The dues deduction provisions of this Article shall continue to pertain and be complied with by the State with regard to those employees who are promoted into excluded classes or positions unless the employee elects to withdraw, or when an employee is transferred, promoted, or demoted from one bargaining unit to another where the Union is the exclusive bargaining agent. 3.2 Hold Harmless a. No provisions of this Article nor any disputes arising thereunder shall be subject to the grievance and arbitration procedure contained in this Contract. b. The Union agrees to indemnify, defend, and hold the State and its agents harmless against any claims made of any nature and against any suit instituted against the State arising from this Article and the deductions arising therefrom.
